These Terms of Service govern access to and use of the Free DNC List Checker website, DNC lookup tools, file processing tools, Federal DNC list registration application checkout, membership features, API access, downloads, and related services (the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

Definitions

"We," "us," and "our" refer to the Service operator. "You" and "your" refer to any visitor, account holder, customer, API user, or other user of the Service. "Content" includes phone numbers, CSV/XLS/XLSX files, account information, payment-related information, registration application information, API requests, notes, and other information you submit. "Output" means results, processed files, downloads, API responses, status labels, and other information generated by the Service.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. If you create an account, you are responsible for maintaining the confidentiality of your credentials, API keys, downloaded files, and any activity under your account or API key.

Account security

You agree to provide accurate information, keep your account details current, protect API keys from unauthorized use, and notify us promptly of unauthorized access or suspected security issues. We may rotate, disable, suspend, or revoke API keys or accounts if we believe they are compromised or misused.

Service description and compliance

The Service provides tools to check a single phone number, upload and process CSV/XLS/XLSX files containing phone numbers, compare submitted numbers against DNC data, download processed results, and use API endpoints for eligible membership tiers. The Service may also provide a one-time application checkout for adding a phone number to the Federal DNC list. Output is informational only and does not constitute legal advice, regulatory advice, or a compliance certification.

You are solely responsible for complying with all applicable laws, regulations, industry rules, consent requirements, calling/texting restrictions, privacy requirements, suppression-list obligations, and recordkeeping duties. The Service is a tool to assist your workflow, not a substitute for your own compliance review.

No reliance

You are responsible for verifying Output and determining whether any outreach, suppression, registration, or compliance action is appropriate. DNC data, phone number formats, regulatory requirements, and third-party systems can change. We do not guarantee that Output is complete, current, uninterrupted, or error free.

Federal DNC list registration applications

If you submit a phone number for Federal DNC list registration through the Service, you authorize us and our service providers to process the submitted phone number, email address if provided, payment confirmation, and related request information for the registration application. The application process may take up to 30 days to reflect in the Federal DNC List system. We do not control government systems and cannot guarantee acceptance, timing, continued listing, or the actions of third parties.

Memberships, API access, and usage limits

Free and guest usage may be limited, including limits on file processing, downloads, or session-based use. Membership tiers may provide additional capabilities such as unlimited downloads, API access, or support features. Business VIP and Enterprise VIP accounts may receive API access where enabled. You may not share API keys, bypass usage limits, scrape the Service, overload the Service, or use automated access except through documented API endpoints and permitted workflows.

User content and permissions

You represent that you have the rights and permissions to upload, submit, process, and use any files, phone numbers, and other data you provide. You grant us a limited license to host, process, transmit, format, store, log, and display your Content as needed to provide, secure, troubleshoot, bill for, support, and improve the Service. You remain responsible for the Content you submit and for any decisions made from Output.

Data limitations

Do not upload information that is not needed for DNC checking or registration, including full payment card numbers in files, government identifiers, health data, credentials, passwords, or other highly sensitive information. Files should contain only the data necessary for the Service to process phone numbers.

Prohibited use

You agree not to misuse the Service, including by attempting to access systems without authorization, uploading malware, probing or attacking infrastructure, reverse engineering non-public systems, using the Service to harass or contact consumers unlawfully, violating privacy, telemarketing, text messaging, data protection, or consumer protection laws, reselling access without permission, or submitting data that you are not authorized to process.

System integrity

You may not interfere with or disrupt the Service, attempt to bypass account, guest, file, download, membership, or API limits, or use automated access that is not explicitly authorized by us. We may monitor usage and apply rate limits, blocks, or other controls to protect the Service.

Fees, billing, and refunds

Certain features require payment. Prices, taxes, plan features, checkout terms, and billing terms are shown at checkout or in the applicable membership, registration, or payment flow. One-time Federal DNC registration application payments do not renew. Subscription or membership plans, where offered as paid recurring plans, may renew automatically each billing period unless stated otherwise and unless you cancel before renewal.

Refund policy: We offer a 30-day no-questions-asked refund from the date of purchase. To request a refund, contact customer service at [email protected]. After 30 days, payments are non-refundable except as required by law.

Billing issues: If a payment fails, we may retry the charge where applicable and suspend paid features until payment is received. You are responsible for chargebacks, dispute fees, or costs resulting from unauthorized or disputed charges caused by your actions or failure to maintain accurate billing information.

Payment processing

Payments are handled by third-party payment processing merchants such as Stripe or other processors made available on the Service. We do not intend to store full payment card numbers or sensitive payment credentials on our servers. Payment processors may collect and process payment details under their own terms and privacy policies.

Downloads and file handling

Processed downloads are provided for your convenience. You are responsible for reviewing downloaded files, maintaining your own backups, and protecting files that contain phone numbers or other personal information. We may remove uploaded or processed files, logs, or inactive account data as part of routine operations, security, storage management, or legal compliance.

Availability and changes

We may modify, suspend, limit, or discontinue any part of the Service at any time, including features, pricing, payment methods, membership tiers, API endpoints, datasets, usage limits, registration application flows, or downloads. We do not guarantee uninterrupted or error-free service.

Suspension and termination

We may suspend or terminate access for violations of these Terms, non-payment, security risk, suspected abuse, legal risk, or unlawful activity. You may stop using the Service at any time by discontinuing access and, if applicable, canceling your subscription or membership.

Intellectual property

The Service, including its software, design, and content, is owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, or distribute it except as expressly permitted.

Feedback

If you submit suggestions or feedback, you grant us a non-exclusive, royalty-free license to use it without restriction.

Third-party services

The Service may link to or integrate with third-party services, including hosting providers, payment processors, email providers, analytics or security tools, government or public data sources, and other operational vendors. We are not responsible for their content, policies, availability, or practices.

Disclaimers and limitation of liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We disclaim warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, and regulatory compliance. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business opportunities, goodwill, or compliance status.

Indemnification

You agree to defend and indemnify us from claims arising out of your use of the Service, your Content, or your violation of these Terms or applicable law.

Electronic communications

You consent to receive notices and communications electronically. We may provide notices by posting them on the site or sending them to the email address on file.

Updates

We may update these Terms from time to time. The updated Terms will apply when posted, and your continued use of the Service indicates acceptance.
